1. Scope and Acceptance

  1. These Terms and Conditions of Use (hereinafter, "Terms") govern the access and use of the Hostme.com.co platform (hereinafter, "Hostme" or "the Platform"), operated by HOSTME S.A.S., with NIT 901760687-8 and principal address in Bucaramanga, Colombia (hereinafter, "Hostme S.A.S."). [cite: 4]
  2. These Terms constitute a binding legal agreement between the user of the Platform (hereinafter, "User") and Hostme S.A.S. By accessing, browsing, or using the Platform, the User acknowledges having read, understood, and fully accepted these Terms. If the User does not agree with these Terms, they must refrain from using the Platform.

2. Definitions

For the purposes of these Terms, the following terms shall have the meanings indicated below:

  1. Reservation Agent: Natural or legal person acting as an intermediary between Owners and Guests for the management of accommodation reservations through the Platform.
  2. Guest: Person who uses the Platform to search, reserve, and/or pay for the rental of accommodations offered by the Owners.
  3. Owner: Natural or legal person who offers accommodations for rent through the Platform.
  4. Platform: The online platform Hostme.com.co, including its website, mobile applications, and any other means through which the Services are provided.
  5. Services: The services offered by Hostme through the Platform, including, among others, the publication of accommodations, reservation management, payment processing, and communication between Guests, Owners, and Reservation Agents.

3. Registration and User Accounts

  1. To access certain Services of the Platform, the User must register and create a user account. The User agrees to provide accurate, complete, and updated information during the registration process and to keep their account information updated.
  2. The User is responsible for maintaining the confidentiality of their access credentials and for all activities that occur under their account. The User agrees to notify Hostme immediately of any unauthorized use of their account or any other security breach.
  3. Creating or using multiple user accounts, as well as the use of false or fraudulent identities, is strictly prohibited. Hostme reserves the right to suspend or cancel any account that violates this provision.
  4. Hostme may, at its discretion, require verification of the identity of Users as a condition for the creation or continued use of an account.

4. Obligations of the Parties

4.1. Obligations of the Guests:

  1. Make payments for reservations in a timely manner, in accordance with the payment policies established on the Platform.
  2. Use the accommodations responsibly and respectfully, complying with the rules of coexistence and the rules established by the Owner.
  3. Report to the Owner or Reservation Agent any damage or defect caused to the accommodation during their stay.

4.2. Obligations of the Owners:

  1. Provide truthful, accurate, and complete information about the characteristics, services, and conditions of the accommodations offered on the Platform.
  2. Maintain the accommodations in adequate conditions of cleanliness, safety, and maintenance.
  3. Comply with local and national regulations applicable to tourist accommodations, including health and safety regulations.

4.3. Obligations of the Reservation Agents:

  1. Act with transparency and diligence in the management of reservations, clearly informing Guests about the conditions of the reservation, cancellation policies, and additional charges.
  2. Have the current and necessary contracts and authorizations with the Owners for the commercialization of the accommodations on the Platform.
  3. Inform Hostme about the commissions or service charges that apply to reservations managed through the Platform.

5. Reservations and Payments

  1. Accommodation reservations will be made through the Platform, following the procedure established for this purpose.
  2. Cancellation policies, refunds, and additional charges will be established by the Owner or Reservation Agent and must be clearly informed to the Guest before confirming the reservation. For example: "Free cancellation up to 48 hours before the arrival date."
  3. Hostme will facilitate the processing of reservation payments through the payment methods accepted on the Platform. Hostme is committed to implementing reasonable security measures to protect the financial information of Users.
  4. The prices of the accommodations will be established by the Owners or Reservation Agents and may vary depending on the season, demand, and other factors.

6. Intellectual Property

  1. All content on the Platform, including, among others, texts, images, logos, trademarks, designs, and software, are the exclusive property of Hostme S.A.S. or its licensors and are protected by applicable intellectual property laws.
  2. The reproduction, distribution, modification, transformation, commercialization, or any other unauthorized use of the content of the Platform is expressly prohibited, unless prior written authorization is obtained from Hostme S.A.S.

7. Privacy and Data Protection

  1. Hostme S.A.S. is committed to complying with Law 1581 of 2012 (Personal Data Protection Law in Colombia) and other applicable regulations regarding privacy and data protection.
  2. The personal information of Users will be collected, used, and processed in accordance with Hostme's Privacy Policy, which is an integral part of these Terms.
  3. Users expressly consent to the use of their personal data by Hostme S.A.S. for the commercial and legal purposes related to the provision of the Platform's Services.

8. Limitation of Liability

  1. Hostme S.A.S. is not responsible for any damages or losses that may arise from the misuse of the Platform or the breach of the obligations of the Users or third parties.
  2. Hostme S.A.S. does not guarantee the uninterrupted availability or error-free operation of the Platform.
  3. To the maximum extent permitted by applicable law, Hostme S.A.S. excludes any implied or explicit warranty in relation to the Platform and the Services.

9. Modifications and Termination

  1. Hostme S.A.S. reserves the right to modify or update these Terms at any time, notifying Users through the Platform or by other reasonable means. Continued use of the Platform after notification of the modifications will imply acceptance of the new Terms.
  2. Hostme S.A.S. may suspend or cancel the account of a User in case of breach of these Terms, fraud, or any other conduct that Hostme S.A.S. considers harmful to the Platform or other Users.

10. Applicable Law and Jurisdiction

  1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia.
  2. Any dispute or claim arising in connection with these Terms shall be resolved exclusively in the competent courts of the city of Bucaramanga, Santander, Colombia.

11. Specific Clauses

11.1. For Reservation Agents:

  1. Reservation Agents must present Hostme S.A.S., when requested, with a copy of the current contracts they have with the Owners of the accommodations they offer through the Platform.

11.2. For Owners:

  1. Owners are obliged to comply with all health, safety, and other local and national regulations applicable to the accommodations they offer on the Platform.
